The letter was very well written and addressed, and although D.Smart did respond very poorly to it, perhaps a thread on their page a little bit further down the page titled "Guard Frequency Episode 081 | The Church of Chris Roberts" and the following picture helped compose the response?

 

I'm not siding with Derek Smart by ANY MEANS.  I'm just wondering if we were all to be mature adults and not feed the flames that perhaps he would go away...  Or maybe not.

I'm only curious how much time he's dedicated to LoD in the past six months. Because he either doesn't sleep like Elon Musk or....no, fuck that. Elon Musk gets almost no sleep and is incredibly productive. DS only produces inflammatory tripe. That's right, Derek Smart is a bleeding ulcer.

Anyway, he is free to do whatever he decides but this may backfire on him.

In his article he claims he has grounds to charge CIG for defamation. 
Reality is he is the one that actually should be worried about that.

He is the one that has made accusations regarding some employees personal lives.
He is the one that started making accusations without proof to back them.

In one of his previous blog posts http://www.dereksmart.org/2015/07/interstellar-discourse/  , he makes a direct attack on Sandi and Eric for instance.

The fact or not that Sandi is Chris Roberts wife is completely irrelevant.

His accusations and personal attacks to CIG employees were done prior to any reaction from CIG. 

If he does want to turn this into a legal battle, CIG may end up being forced to disclose information. But if proven "innocent", CIG is in every right to accuse Derek Smart and request a compensation for the damages he has inflicted to CIG image.

Sandi and Chris are a couple but there's no harm in that. They both get their jobs done. So the defamation part is missing from the countersuit.

It's all a matter of burden of proof.

If he sues ( and most likely he won't) he has no legal cause for action ( he has been refunded), he has to prove or at least give very very good cause for suspicion that there has been money mishandling using only his sources ( very hard to do) and at best he can aim for a refund ( yeah...).

If things go DS way ( dreamy lil world I know): he keeps prodding CR/Sandi/CIG until they sue him, then if they say that he is slandering them about mismanaging the money the burden of proof is on them and they have to open the books in order to show it ( which is what he wants). On top of that being sued opens the door for contersuing and damage compensations and rumors say he's a lil short on cash.

Luckily CIG has a quite good and well known lawyer as a cofouner so I doubt they will fall for it.

BTW the fact CIG doesn't want to show the books means nothing: even if everything is in order ( like I believe) he will start riling poeople and bitching at their choices until the game is out ( why they rented here and not there, why this guy is getting this much money, hiring that studio would have been better, who is in the cast for SQ42), giving him fuel for ages for the flame wars he is so famous for.

 

As a further note, to all that think that, well, in the  end, it's a good thing if CIG shows the books in the name of being open: this guy says he is doing it in our name, for justice and fairness.

And is plan to achieve that is that CR should step down and hand his accounting books to a forensic ( as in: specialist about finding iregualarities) accountant, which DS, as the chief of a rival enterprise ( he keeps comparing LOD to SC) and as a man with a long querelle with CR, would graciously have on his payroll ( he said he would pay for it).

Like if Burger King said that unless the head concho of MC Donalds resigns and they hand them their accounting books they will sue them for whatever reason.

All fair and square, really......
